Everylot is a product name of, and is operated by, Elowin Labs LLC. References to "Everylot", "we" or "us" mean Elowin Labs LLC doing business as Everylot. By using the site you agree to these terms.

1. The service

The site is a search engine over used-vehicle listings that dealers publish on their own public websites. It shows the facts of a listing (vehicle, price, mileage, location, dealer) with a reduced preview image, and links to the dealer's page. It is provided free of charge and without accounts.

2. Not a seller, not an agent

We do not sell vehicles, take payments, hold inventory, or act for any dealer or buyer. Every transaction is between you and the dealer, on the dealer's terms. Prices, availability, mileage and other facts come from the dealer's page at the time we last read it and can be wrong or out of date; confirm everything with the dealer before relying on it.

3. Acceptable use

Do not interfere with the site's operation (for example by automated requests designed to overload it), scrape it at volume without asking, or use it to harass anyone. Dealers and other publishers may control our crawler through robots.txt as described on the crawler page.

4. Intellectual property

The site's design, code and explanatory text belong to Elowin Labs LLC. Vehicle facts are not owned by anyone. Listing photographs belong to the dealers or their photographers; we display reduced previews as a search index does, with a link to the source, and honor removal requests through the removal page. Vehicle makes and models are trademarks of their manufacturers, used only to identify the vehicles.

5. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY LISTING IS ACCURATE, CURRENT OR AVAILABLE, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELOWIN LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM A VEHICLE PURCHASE OR FROM RELIANCE ON A LISTING. BECAUSE THE SITE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO ONE HUNDRED US DOLLARS.

7. Changes and termination

We may change or discontinue the site, or these terms, at any time. Changes take effect when posted here.

8. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Palm Beach County, Florida. If you are a consumer, nothing in these terms removes rights that the law of your place of residence grants you and that cannot be waived by contract.
